N° 403.Provided as isTerms.

TREVOR McKENDRICK

The TERMS of SERVICE of T-Mail;

such as they are.

Effective October 21, 2026. These terms are an agreement between you and Optimism Labs LLC (“Optimism Labs”, “we”, “us”) about the T-Mail apps for Mac and iPhone. By using T-Mail you agree to them and to the Privacy Policy. If you don’t agree, don’t use T-Mail.

1. USE.

We give you a personal, non-exclusive, non-transferable, revocable license to use T-Mail. Use it lawfully and in line with Google’s terms. We may change T-Mail, stop offering it, or end your license at any time, without notice.

2. YOUR RESPONSIBILITY.

You are responsible for your accounts and for everything sent, changed or deleted through T-Mail, including by AI agents you connect to it. Check what agents do; we can’t guarantee how they behave.

3. OTHER SERVICES.

T-Mail depends on Google, Apple and any service you connect. We don’t control them and are not responsible for them.

4. NO WARRANTY.

T-MAIL IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DON’T PROMISE THAT T-MAIL WILL WORK, BE SECURE OR BE FREE OF ERRORS, OR THAT EMAIL WON’T BE LOST, DELETED, DELAYED, OR SENT WHEN OR WHERE YOU DIDN’T INTEND.

5. LIMIT OF LIABILITY.

TO THE FULLEST EXTENT THE LAW ALLOWS, NEITHER OPTIMISM LABS NOR ITS MEMBERS, MANAGERS, EMPLOYEES OR AGENTS IS LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, EMAIL, PROFITS, REVENUE OR GOODWILL, ARISING FROM T-MAIL OR THESE TERMS, UNDER ANY LEGAL THEORY, EVEN IF TOLD THEY WERE POSSIBLE. THEIR COMBINED TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF WHAT YOU PAID OPTIMISM LABS FOR T-MAIL IN THE 12 MONTHS BEFORE THE CLAIM AND US$50. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

6. INDEMNITY.

You will defend, indemnify and hold Optimism Labs and its members, managers, employees and agents harmless from any claim, loss or cost (including reasonable lawyers’ fees) arising from your use of T-Mail, your email, or your breach of these terms or the law.

7. DISPUTES.

Utah law governs these terms, without regard to its conflict-of-laws rules. Any dispute about T-Mail or these terms will be settled by binding arbitration on an individual basis under the American Arbitration Association’s Consumer Arbitration Rules, held in Salt Lake County, Utah or by video. Either of us may instead bring an individual claim in small claims court. YOU AND OPTIMISM LABS EACH GIVE UP THE RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS OR REPRESENTATIVE ACTION. The Federal Arbitration Act governs this section. If arbitration is unavailable, the state and federal courts in Salt Lake County, Utah have exclusive jurisdiction. Any claim must be brought within one year after it arises, or it is barred.

8. APPLE.

If you got T-Mail through Apple (the App Store or TestFlight), these terms are between you and Optimism Labs, not Apple. Apple has no duty to support or maintain T-Mail, gives no warranty for it, and is not responsible for any claim about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.

9. GENERAL.

These terms and the Privacy Policy are the whole agreement between us about T-Mail. If any part is unenforceable, it is limited as little as needed and the rest stays in force. Not enforcing a part is not a waiver of it. You may not transfer these terms; we may. Sections 2 through 9 survive the end of your license. We may change these terms; the date at the top says when they last changed, and if you keep using T-Mail after a change, the new terms apply.
